The agreement
These terms are a contract between Arcify (“we”, “us”) and the business that opens an account (“you”). By creating an account or using the service you accept them. Arcify is built for businesses; you confirm you are using it in the course of business, not as a consumer.
The service
Arcify is a subscription business suite. Your plan tier decides which apps your account gets; every app in your tier is switched on, and there are no caps on users, sites or volume of work. We improve the service continuously and may add, change or retire features — if we retire something your business depends on, we will give you reasonable notice.
Accounts and the trial
New accounts start with a 14-day free trial of the whole suite, no card required. You are responsible for the people you invite: keeping credentials safe, choosing sensible roles, and removing access when someone leaves. You must be authorised to act for the business you sign up.
Fees and billing
- Plans are priced per user, exclusive of VAT. What each person costs depends on the seat they hold: a full seat is charged at your plan’s rate, and a crew seat — a limited seat for people who are assigned work rather than quoting or invoicing it — is charged at a lower rate. - You choose whether to be billed monthly or yearly. Yearly billing is charged twelve months in advance.
- Adding a person raises your bill and removing one lowers it. On monthly billing the difference is applied to your next invoice. On yearly billing, adding a person is invoiced when you add them, for the remainder of your year; removing a person is credited against your renewal rather than refunded.
- There is no lock-in on monthly billing: you can cancel at any time and your plan runs to the end of the period you have paid for. Yearly billing is paid twelve months in advance and runs to the end of that year.
- We will give you at least 30 days’ notice before any price change takes effect.
Your data
The data your business stores in Arcify belongs to your business. We process it only to provide the service, as described in our privacy policy. You can export your data — including the full ledger — while your account is open. You are responsible for having the right to store the data you put in, including your own customers’ personal data, for which you are the controller and we are your processor under our data processing agreement, which forms part of these terms.
Acceptable use
Our acceptable use policy is part of these terms. In short: no unlawful use, no spam, no attempts on the service or other tenants’ data, no resale. We may suspend an account that puts other customers or the service at risk, and will tell you why.
Availability and support
We work to keep Arcify available around the clock, but no online service is uninterrupted: maintenance, upgrades and events outside our control can cause downtime. Support is included with every plan, with priority and onboarding support on higher tiers as described on the pricing page.
Liability
Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud. Otherwise, our total liability in any 12-month period is capped at the fees you paid us in that period, and neither side is liable for indirect losses such as lost profits or lost business. The service is provided as described — we make no promises beyond what these terms and our published materials state.
Ending the agreement
You can close your account at any time. We can end the agreement with notice if you materially breach these terms and do not put it right, or if we withdraw the service — in which case we will give you at least 90 days’ notice and the means to export your data first.
General
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If part of these terms turns out to be unenforceable, the rest still stands. Questions: support@arcify.co.uk.
